Carer's Allowance and Residence and Presence Tests

To receive the Carer's Allowance, you need to be able to prove that you have lived and been present in the United Kingdom for over 26 weeks over the past year.

The benefit will not be awarded if the claimant is subject to immigration control, with the following exceptions:

- You are the family member of a European Economic Area National.

- You or a member of your family with whom you are living are a national of Morocco, Algeria, Tunisia or Turkey and have lawfully worked or are working in the UK.

- You are a sponsored immigrant and the subject of a mantenance undertaking whereby someone has agreed to be responsible for your maintenance and accommodation in this country.

If you have been granted humanitarian protection, refugee status, or discretionary leave, then you are no longer subject to immigration control.
